dc.description.abstractO presente estudo trata da análise da legislação e atos normativos sobre a prática do nepotismo no Poder Judiciário da União, com o advento da edição pelo Conselho Nacional de Justiça, em 18 de outubro de 2005, da Resolução N. 07, que deu gênese à discussão se o recém criado Conselho teria competência para tratar da matéria por intermédio de resolução administrativa, tendo em vista o que dispõem algumas leis ordinárias a respeito da matéria. Instado a manifestar-se por intermédio de julgamento de medida cautelar em ação declaratória de constitucionalidade ajuizada pela Associação dos Magistrados Brasileiros, o Supremo Tribunal Federal reconheceu, com efeito vinculante, o caráter normativo primário ao referido diploma, assegurando que o Conselho Nacional de Justiça é órgão integrante do Poder Judiciário e que, o ato normativo em comento, nada mais fez que explicitar os princípios da Administração Pública, elencados no artigo 37 da Carta Política, garantindo a isonomia, a impessoalidade e a moralidade no âmbito do Poder Judiciário, quanto à nomeação de parentes de autoridades e servidores para Cargos em Comissão e Funções Gratificadas.pt_BR
dc.description.notasThe present study treated about the analysis of the legislation and normative on the practice of the nepotism in the Judiciary Power of the Union, with the coming of the edition by the National Council of Justice, on October 18, 2005, of the Resolution N.07, that gave genesis for the discussion if the recently created Council would have competence to treat the matter through administrative resolution, having in mind what some ordinary laws regarding the matter dispose. Urged to manifest through judgment of precautionary measure in Constitutionality Declaratory Action by the Association of the Brazilian Magistrates, the Supreme Federal Court recognized, with entailing effect, the primary normative character to the referred diploma, assuring that the National Council of Justice is an integrant organ of the Judiciary Power and that, the normative action in comment on, made nothing else than to make explicit the principles of the Public Administration, included in the 37 article of the Political Letter, guaranteeing the isonomy, the impersonality and the morality in the ambit of the Judiciary Power, in regard to the authorities’ and servants’ relatives nomination for positions in commission and rewarded functions.pt_BR
